1. Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING!
2. Eligibility. This Great Golf Cart Giveaway is open to legal residents of the 50 United States who are least 18 years of age at time of entry to qualify. This giveaway is subject to federal, state, and local laws and regulations and void where prohibited by law. Impact Powersports, LLC employees, its subsidiaries, and affiliates as well as members of an employee’s immediate family and/or those living in the same household of employees are ineligible to participate in the Great Golf Cart Giveaway.
3. Sponsorship. Impact Powersports, LLC located at 11630 14 Mile Road, Rockford, Mi 49341. Impact Powersports, LLC will conduct The Great Golf Cart Giveaway substantially as described in these Official Rules.
4. Agreement to Rules: By entering this Great Golf Cart Giveaway, the entrant agrees to abide by Impact Powersports, LLC official rules and decisions, which are fully and unconditionally binding in all respects. Impact Powersports, LLC reserves the right to refuse, withdraw or disqualify any entry at any time at Impact Powersports, LLC sole discretion. By entering the Great Golf Cart Giveaway it represents and warrants that you are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of Impact Powersports, LLC as final and binding as it relates to the content of the Great Golf Cart Giveaway.
5. The Great Golf Cart Giveaway Entry Period. This promotion begins November 13, 2023 12:01AM Eastern Time to August 21, 2024 12:01AM Eastern Time. To be eligible for the Great Golf Cart Giveaway, entries must be received within the specified entry period.
6. How to Enter. Eligible entrants can enter the Great Golf Cart Giveaway by a text to win campaign, texting the word Impact to 21000 with a limit of 6 entries per month and at Impact Powersports, LLC events. As a participant, your entry must fully meet all the Great Golf Cart Giveaway requirements, as specified in the Official Rules, in order to be eligible to win. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at Impact Powersports, LLC sole discretion.
7. Prizes. The winner of the Great Golf Cart Giveaway will receive The Lomas Brown Lions Golf Cart Valued at $12,000. The actual/appraised prize value may differ at the time the prize is awarded. There shall be no cash or other prize substitution permitted except at Impact Powersports, LLC discretion. The prize is non-transferable. The winner, upon acceptance of the prize, is soley responsible for all expenses related to the prize, including without limitatiion any and all local, state, and federal taxes. The winner shall not transfer assignment of the prize to others nor shall the winner request the cash equivalent or prize substitution. By accepting the prize, the selected winner grants permission for Impact Powersports, LLC to use the winner’s likeness, entry, and name for purposed of advertising and trade without further compensation unless prohibited by law.
8. Odds. The total number of eligible entries received determines the odds of winning.
9. Selection and Notification of the winner. The winner will be selected by a random drawing under the supervision of Impact Powersports, LLC. Impact Powersports, LLC will notify the winner by email or phone within 5 days following winner selection. Impact Powersports, LLC is not responsible for nor shall have no liability for winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall Impact Powersports, LLC be liable for the winner’s provision of incorrect or otherwise non-functioning contact information. If the winner 1) fails to claim the prized within 30 days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an alternate winner may be selected. Receipt of the prize (offered in the Great Golf Cart Giveaway promotion) by the winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT IMPACT POWERSPORTS, LLC SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
10. Rights Granted by You. By submitting an entry (via text campaign or registration into this promotion, you understand and agree that Impact Powersports, or any individual acting on Impact Powersports, LLC behalf, and the licensee’s successors, and assigns of Impact Powersports, LLC shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image statements about the Great Golf Cart Giveaway promotion and your biographical information for news, publicity, advertising, promotional purposed, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.
11. Terms & Conditions: In its sole discretion, Impact Powersports, LLC reserves the rights to modify, suspend, cancel, or terminate the Great Golf Cart Giveaway promotion should non-authorized human intervention, a bug or virus, fraud, or other causes beyond Impact Powersports control, impact or corrupt the security, fairness, proper conduct, or administration of the Great Golf Cart Giveaway. Impact Powersports, LLC, in the event of any of the above issues, may determine the winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by Impact Powersports LLC. Individuals who tamper with or attempt to tamper with the operation or entry process of the Great Golf Cart Giveaway or violates these terms & conditions will be disqualified by Impact Powersports, LLC in its sole discretion. In it’s sole discretion, the sponsor has the right to maintain the integrity of the Great Golf Cart Giveaway, to void votes for any reason, including but not limited to identify any disallowed entry methods that will result in votes/entries being voided.
12. Limitation of Liability. Your entry into the Great Golf Cart Giveaway constitutes your agreement to release and hold harmless Impact Powersports, LLC and its subsidiaries, representatives, affiliates, partners, successors, agents, assigns, directors, employees and officers against and from any and all claims, liability, illness, injury, death, litigation, loss or damages that may occur, directly or i indirectly from participation in the Great Golf Cart Giveaway and/or 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone or internet service; 4) unauthorized intervention in any part of the entry process or the promotion; 5) electronic error or human error in the promotion administration or the processing of entries.
13. Disputes. THIS PROMOTION IS GOVERNED BY THE LAWS OR THE UNITED STATES AND MICHIGAN, WITHOUT RESPECT TO CONFLICT LAW DOCTRINES. The entrant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the entrant and Impact Powersports, LLC, and if causes of action arise out of or are connected with this promotion, they shall be individual resolved exclusively as all claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Michigan without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pockets expenses (i.e. costs associated with entering this promotion). The participant waives all rights to have damages multiplied or increased.
